Basis of GSMA Block List Information
GSMA Device Check and Stolen Phone Checker® identify mobile devices which have been flagged to block the sale and/or use on one or more wireless networks.

The GSMA Block List contains data pertaining to a range of mobile device identities that have been provided to the GSMA by numerous third party data sources. You acknowledge that GSMA provides a platform for the exchange of device data only, and that GSMA does not vet GSMA Block List data. You acknowledge and agree that the GSMA, its licensors, contributors, and mobile network operators have no responsibility for the accuracy, currency or completeness of the GSMA Block List data or the Device Check services.

You acknowledge that consumers who lose or have their phone stolen may take some time to report their device lost or stolen. You acknowledge that the status of a device may change after a check has been performed.

It can take up to twenty-four (24) hours, and sometimes longer, from the time someone reports a device as lost or stolen or found before data relating to the status of that device is uploaded to the GSMA Block List. ACCORDINGLY, THE GSMA GROUP (DEFINED BELOW) ASSUMES NO LIABILITY AND DOES NOT REPRESENT OR WARRANT THAT THE DATA PROVIDED IN THE GSMA BLOCK LIST IS ERROR FREE, ACCURATE OR TIMELY.

In certain circumstances, a wireless carrier may block a particular wireless device because of billing issues with the owner. The wireless device would not appear on the GSMA Block List for such, but the wireless device may remain blocked with that wireless carrier. Other wireless carriers may or may not allow such a wireless device to be used on their networks. Therefore, the fact that a wireless device does not appear on the GSMA Block List does not guarantee it will not be blocked.

We recommend that you always acquire wireless devices from a trusted and reputable source.

You and GSMA shall treat device identifier-related information exchanged through the GSMA Block List™ as "personal data" for the purposes of data protection regulation. As part of this commitment, each of GSMA and you shall:

  • comply with relevant data protection laws in its role as an independent Data Controller, including the requirements of the General Data Protection Regulation (GDPR) (EU) 2016/679;
  • use reasonable commercial endeavours to prevent unauthorised access to or manipulation of the GSMA Block List™ information;
  • limit access of data to authorised personnel on a need-to-know basis; and
  • promptly notify the other in the event of any relevant data breach.

You and GSMA agree that the transfer of personal data (including any device identifier or related information) from within the European Economic Area, United Kingdom or Switzerland to any other jurisdiction (save for to a third country subject to an adequacy decision by the European Commission), shall be subject to the Standard Contractual Clauses for the Transfer of Personal Data from the Community to third countries (controller to controller transfers) (Set II) as set out in the Annex to Commission Decision 2004/915/EC (SCCs) . For the purposes of the SCCs, “data importer” means the party receiving the Personal Data; and “data exporter” means the party disclosing the Personal Data; (3) for Section II(h), the data importer selects option (iii); and (4) for Section VIII and Annex B, the details of the transfers shall be as specified in the remainder of this agreement. GSMA LTD., GSM ASSOCIATION AND MEMBERS OF THE GSM ASSOCIATION (THE "GSMA GROUP") AND THEIR LICENSORS AND OTHER CONTRIBUTORS DO NOT WARRANT OR REPRESENT THAT THIS SITE OR THE GSMA BLOCK LIST WILL OPERATE ERROR-FREE OR WITHOUT FAILURE OR INTERRUPTION, OR THAT ANY COMMUNICATION BETWEEN YOU AND GSMA LTD. WILL BE PRIVATE OR SECURE.

THE GSMA GROUP EXPRESSLY DISCLAIMS ANY OTHER REPRESENTATIONS, WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF FITNESS FOR PARTICULAR PURPOSE, OR RELIABILITY OR AVAILABILITY OF THIS SERVICE OR THE GSMA BLOCK LIST.

IN NO EVENT WILL THE GSMA GROUP OR ITS LICENSORS OR CONTRIBUTORS OR ANY PERSON OR ENTITY INVOLVED IN LICENSING, IN CREATING, PRODUCING OR ADMINISTERING THE SITE OR THE GSMA BLOCK LIST, BE LIABLE IN CONTRACT, IN TORT (INCLUDING FOR ITS OWN NEGLIGENCE) OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, LOSS OF USE, OR SIMILAR ECONOMIC LOSS, ARISING OUT OF THE USE OF THIS SERVICES OR THE GSMA BLOCK LIST.
